To claim a VAT refund in Nigeria, you must file the claim with the Nigeria Revenue Service (NRS) within 12 months of the transaction that gave rise to it, backed by a claim schedule and proof that the VAT was remitted. NRS must then process a valid claim within 30 days, either paying the refund or applying it against other tax you owe. Miss the 12 months and the right is lost.
The rules come from the NRS Guidelines on Tax Refund(s), dated 29 June 2026 and made public on 30 July 2026. They rest on sections 55 and 56 of the Nigeria Tax Administration Act 2025 and section 155(2) of the Nigeria Tax Act 2025. Many finance teams have not yet built a process around them.
When does a business qualify for a VAT refund?
The guidelines describe five situations in which a refund can arise:
- Excess input VAT. Your input VAT is higher than your output VAT for the period. Exporters and zero-rated suppliers meet this often.
- Donor-funded humanitarian projects. VAT paid on project costs that the grant was meant to cover.
- VAT deducted at source. Your customer withheld the output VAT, so you have no output tax against which to recover your input VAT.
- Errors or omissions. You paid more VAT than the law required.
- Exempt or zero-rated items. VAT was charged on a supply that should not have carried it.
What documents does NRS expect with a refund claim?
Build the file before you submit. The documents listed in the guidelines are:
- A claim schedule listing each transaction.
- Proof that the VAT was remitted to NRS, including NRS receipts.
- Evidence of zero-rated supplies, where that is the basis of the claim.
- Import documents, where the claim involves imported goods.
- Exemption certificates, where an exemption applies.
How do you file a VAT refund claim, step by step?
- Date the oldest item. Take the earliest transaction in the claim and add 12 months. That is your cut-off. An invoice dated 15 November 2025 must be in a claim by 15 November 2026.

- Match withheld VAT to the schedules. Where a government body or appointed agent withheld VAT from you, match each deduction to the invoice. Buyers must remit withheld VAT by the 14th day of the following month, so the remittance evidence should already exist. The same discipline applies to the WHT credit process.
- Build the claim schedule and attach support. Use the document list above. Gaps here are what slow a claim down.
- State how you want to be paid. The guidelines allow a cash refund or an offset against other tax liabilities, at your request. Say which one you want in the claim.
- Track the 30 days. Diarise the receipt date. If day 31 passes with no payment or offset, escalate in writing and quote the guidelines.
What happens if a refund claim is wrong?
A fraudulent claim carries a penalty of 100% of the refund, plus interest at the Central Bank of Nigeria Monetary Policy Rate. An honest error is a different matter, but only a clean reconciliation lets you show that it was one.
What does this mean for your business?
The 12-month clock is the main risk. Transactions from October 2025 reach their cut-off this month, and November 2025 follows next. If your business carries unrecovered input VAT from last year, check those invoices first.
The rules bite hardest in four places. Agribusinesses and other exporters carry input VAT on zero-rated sales. Construction and oil and gas contractors see customers withhold VAT at source. NGOs run donor-funded projects where VAT is a real cost. And any finance team that files monthly VAT returns but has never claimed a refund is probably leaving cash with NRS.
