Is rent subject to VAT in Nigeria? No. Under the Nigeria Tax Act 2025, rent is exempt from VAT, and the Nigeria Revenue Service (NRS) said in a public notice dated 16 February 2026 that this covers both residential and commercial rent. If your landlord is still adding 7.5% to your rent invoice, that charge needs a second look.
That is today's myth, and it works in both directions. Some landlords keep charging VAT out of habit. Some tenants keep paying it and claiming it back.
Myth: landlords can charge VAT on all rent
Fact: they cannot. ThisDay reported on 16 February 2026 that the NRS list of supplies removed from VAT includes "Rent (both residential and commercial)", along with the lease and sale of eligible residential property. Taiwo Oyedele, chairman of the Presidential Fiscal Policy and Tax Reforms Committee, said land, buildings and rent are now fully exempted. The NRS added that the Act has already commenced and that there is no postponement to 2027.
A Charis Legal Practice article published on Mondaq on 24 February 2026 lists the same point among 13 tax myths: interest in land or buildings, including rent for shops, offices and flats, is VAT-exempt.
Does the exemption cover commercial rent?
The NRS notice says so in terms. Two other summaries we read say only "land, buildings and rent", and one ThisDay line limits the sale and lease exemption to residential property. So the safest reading for a shop, office or warehouse tenant is this: rent itself is exempt, but check the lease and the supply before you rely on that for anything beyond plain rent.
What should tenants check on the invoice?
Go through each rent invoice from January 2026 onward. Three things matter:
- Is VAT shown on the rent line? If yes, ask the landlord for the legal basis in writing.
- Is VAT shown on other lines? Service charges, parking and facility management are different supplies from rent. We have not verified how the NRS treats them, so ask your adviser before you challenge or accept those charges.
- Are you claiming it as input VAT? A claim on VAT that should never have been charged can be disallowed in an NRS review.
If you have already paid VAT on rent this year, raise it with the landlord first. A landlord who collected VAT should not hold it, and one who remitted it may need to correct the returns.
What should landlords do?
Stop adding VAT to plain rent, and review the VAT returns filed since January. Exempt supplies work differently from zero-rated ones, a point we explain in our post on zero-rated and exempt VAT. In short, an exempt supplier does not recover input VAT on costs linked to that supply the way a zero-rated supplier does. A landlord who also has VATable income, such as a hotel or a service business, should have the costs split properly.
Individuals have a separate relief. ThisDay reports rent relief of up to ₦500,000, capped at 20% of annual rent, and a stamp duty exemption for leases valued below ₦10 million. Those are personal tax points and do not change the VAT position.
What this means for your business
Rent is often the second or third largest cost line. A 7.5% charge on it is real money: on ₦40 million of annual office rent, that is ₦3 million. If it is being charged wrongly, you are overpaying. If you claim it back, you carry the risk.
Three actions this week: pull every lease and rent invoice issued since 1 January 2026; flag any VAT on the rent line; write to the landlord and copy your tax adviser. Keep the correspondence, because it is your evidence if the NRS asks. The same habit of keeping a paper trail is covered in our guide to keeping tax records.
FAQ
Is commercial rent subject to VAT in Nigeria in 2026? No. The NRS public notice of 16 February 2026 lists rent, residential and commercial, among supplies removed from VAT under the Nigeria Tax Act 2025.
Can a tenant recover VAT already paid on rent? Start with the landlord, who collected it. A tenant should not claim it as input VAT, since the charge was not due. Ask your tax adviser how to document the refund request.
Are service charges also exempt? We could not verify that from the sources we read. Treat service charges as a separate question and get written advice before you dispute or accept VAT on them.
